**ROFR Thread 2014 JULY-DEC** Please read 1st post for instructions

As mentioned, I have a new contract pending ROFR with disney now, but here are the details of the one just taken by the mouse:

mjmsp111---$78-$15,600-200-SSR-Aug-, 180/'13, 200/'14, 200/'15, 250/'16-sent 11/24, TAKEN 12/24.

From what I can tell. They love those loaded contracts.

Another 6 months have come and almost gone, and I will volunteer for another 6 months of running this thread (Jan '15-June '15).

Now it's your turn to let me know if there is any other information that you'd like to see on the chart? Has the chart been easy for you to read/follow? Should I continue with both the list chart and the CODE chart? Any other input????
Just the code chart is my preference -- easier to read/simplifies the first post/avoids duplication.
One thing I was thinking of adding is listing the asking price and the selling price to give everyone an idea of what kind of offers are being negotiated. Not sure if this would be useful. :confused3

Well it's been 41 days now since sent to Disney for ROFR! Just waiting. This seems to be longer than most experiences that I have researched. Sent out on 11/22. Was told that it could have something to do with holidays and something about the computer system being down. This is our first purchase attempt and kind of a weird start. I didn't know what to expect but must admit I thought the communication would be a little more. Here's to hoping.

Its always been my understanding that Disney has 30 days, period. If they dont respond within 30 days their window has passed and you are good to go. They only have 30 days.

Not true none of the brokers will move to closing without the ROFR waiver from Disney.

I don't doubt that but having looked into it further I'm pretty sure a lawyer would see the original contract with DVC that clearly states 30 days and would win in court if it went that far but I certainly dont think any broker would dare challenge Disney. Theyll let Disney bend the rules, which Disney knows. But the agreement on the original DVC purchase gives Disney 30 days.

I'd wait until Monday. Then contact your broker again. I'm sure that the holiday are wreaking havoc with their timelines which may be why many not the late Oct and early Nov ROFR's were cleared so quickly.

The Mouse exercised his ROFR. We are really bummed. I've revised the sent date to the actual date that the broker sent it to Disney.

This is our first one and we're so excited! Hoping this contract goes through because we really want to be close to Food&Wine...fingers crossed that the Mouse doesn't exercise his ROFR.

DVC may have been looking for a contract in a specific unit, to combine it with points they had on hand to make a larger contract to sell direct. While they can combine and divide to sell new size contracts, each new contract must be from a single unit- which concept doesn't effect member use, but is a legal requirement- a vestige of other timeshare systems where you actually own a week in a specific room number. My understanding is that DVC "units" are actually groups of a small number of rooms.

Or, the ROFR team may have rolled snake eyes one one contract and seven on the other.

Who knows how they do it, doesn't really make sense on the surface, but there are clearly factors other than just UY and price that come into play.
 
Spoke with our agent today and they looked at some notes stating that Disney forgot to look at our contract. That they are now putting it through a rush ROFR. Still not given a timeframe. I guess 30 days is just a suggestion. Will let you guys know what we hear.

This is crap. 30 days is not a guideline. In the original purchase agreement between the now seller and Disney it states 30 days. Contracts aren't guidelines or suggestion they are legal binding agreements that apply to both parties and it states Disney has 30 days. It doesn't say Disney has however long they want. If anyone would ever challenge Disney you'd win, but no broker will dare do it.
